Phoenix housing market update:
I am facing a foreclosure...
Many Phoenix residents have seen their financial situation change due to the loss of employment, mortgage payment increases, medical expenses or an increase in taxes. First thing to remember, you are not alone! Unfortunately, many families are facing a foreclosure and most have no idea what to expect. The distressed property experts at Bloom / Van Omen & Associates has been working closely with banks to provide homeowners with the best option to resolve their situation.
Here Are 9 Ways to Avoid Foreclosure:
1. Reinstatement: Bring the loan current
2. Forebearance: Temporary repayment plan
3. Refinance: New loan with reduction in monthly payments
4. Loan Modification: Modify original loan terms
5. Sell the Property: Use equity to payoff or pay the difference
6. Rent the Property: Must make loan current
7. Short Sale: Negotiate with the bank to accept the sale under the loan amount
8. Deed in Lieu of Foreclosure: "Friendly foreclosure"
9. Bankruptcy: Will stall foreclosure, but not prevent it

If foreclosure is your best option, here's an idea of what you might expect:
First month missed payment: You will receive a letter or phone call from your lender. Second month missed payment: Your lender will begin calling you to discuss why you are not making your payments. Make sure you take the phone calls and let them know your situation. By now, maybe you can make one payment to keep yourself from being three months behind. Third month missed payment: After the third missed payment, your lender will send you a letter stating the amount you are delinquent and that you have 30 days to bring the mortgage current. This is called a "Demand Letter" or "Notice to Accelerate". The letter states that if you cannot pay the specified amount by the provided date, they may begin the foreclosure process. You still have time to work something out with the lender at this point, such as a loan modification or a short sale. Fourth month missed payment: You are very close now to the end of the time allowed in the Demand Letter. If you are not able to pay the full amount or work something out with a housing counselor, you will be referred to the lender's attorney. All legal fees incurred by the lender are your responsibility. Public Trustee's Sale: The lender's attorney will now schedule a sale. This will serve as the actual day of the foreclosure. You may be notified by mail or a taped note to your front door. The time between the Demand Letter and the actual sale varies. This could be as quick as 2-3 months. You are not required to move out yet, but you are getting very close. You have until the sale date to pay the amount due in full, including attorney fees. Redemption Period: there is a brief period where you can reclaim your home after it is sold at auction. You will be notified of the time frame with your Sale notice.
